Terms of Service

Please read these Terms of Service carefully before accessing or using MindMotion's services. By booking an appointment or using our services, you agree to be bound by these terms. If you have any questions, please contact us before proceeding.

1. About our services

MindMotion provides professional counselling, psychotherapy, coaching, mental health assessments, NDIS support services, and professional training. Our services are delivered by qualified practitioners in person at our Melbourne practice and via telehealth. Our services are not a substitute for emergency mental health care. If you are in crisis, please contact Lifeline on 13 11 14 or attend your nearest emergency department.

2. Eligibility

Our services are available to individuals aged 18 and over, and to minors with the written consent of a parent or legal guardian. By booking a session, you confirm that you are either 18 years of age or older, or that you have obtained the required parental or guardian consent. We reserve the right to decline or discontinue services where we determine it is not clinically appropriate or safe to do so.

3. Booking and appointments

Appointments are booked through our Practice Better client portal or by contacting us directly. A booking is confirmed once you receive a confirmation email. We offer a free 15-minute initial consultation to help you determine whether MindMotion is the right fit for your needs. Session times are allocated specifically for you; please arrive (or log in for telehealth) on time. Late arrivals may result in a shortened session at the full session fee.

4. Cancellation and rescheduling policy

We require a minimum of 48 hours' notice to cancel or reschedule an appointment. Cancellations made with less than 48 hours' notice will incur a cancellation fee of 50% of the session fee. No-shows (failure to attend without notice) will be charged the full session fee. We understand that emergencies occur; please contact us as soon as possible if you are unable to attend. Repeated late cancellations or no-shows may result in a requirement to pre-pay for future sessions or discontinuation of services.

5. Fees and payment

Our current fee schedule is available on our Services page and through our booking portal. Fees are payable at the time of service unless a prior arrangement has been made. We accept payment via credit card, debit card, and bank transfer. Medicare rebates may be available for eligible clients with a valid Mental Health Treatment Plan (MHTP) from their GP. NDIS funding may be used for eligible services. It is your responsibility to ensure your funding is in place before your appointment. Fees are subject to change; we will provide reasonable notice of any fee increases.

6. Telehealth services

Telehealth sessions are conducted via Zoom or through our Practice Better client portal. You are responsible for ensuring you have a stable internet connection, a private and quiet environment, and appropriate technology (device with camera and microphone). Telehealth is not suitable for all clients or all presentations; your practitioner will advise if in-person attendance is recommended. By participating in telehealth, you acknowledge that you are located in Australia and that you consent to the session being conducted online. Sessions are not recorded without your explicit written consent.

7. Confidentiality

All information shared in counselling sessions is confidential, subject to the exceptions outlined in our Privacy Policy. These exceptions include risk of harm to yourself or others, mandatory reporting obligations, and court orders. Your practitioner will discuss the limits of confidentiality with you at your first session.

8. Client responsibilities

To get the most from your sessions, we ask that you: attend appointments on time and prepared to engage; communicate openly and honestly with your practitioner; provide accurate information about your health history and current situation; follow through on agreed actions between sessions; notify us promptly if your circumstances change in a way that may affect your treatment; and treat our staff with respect. We reserve the right to end a session or discontinue services if a client behaves in a threatening, abusive, or disrespectful manner.

9. Scope of practice

Our practitioners are qualified counsellors and mental health practitioners. They do not prescribe medication and are not medical doctors or psychiatrists. If medication or a psychiatric assessment is indicated, we will refer you to an appropriate professional. Our services complement but do not replace medical treatment. Please inform your practitioner of any medications you are taking and any other health professionals involved in your care.

10. Complaints and feedback

We are committed to providing high-quality, ethical services. If you have a concern or complaint about your experience with MindMotion, please contact us at [email protected] in the first instance. We will acknowledge your complaint within 5 business days and aim to resolve it within 30 days. If you are not satisfied with our response, you may contact the Australian Counselling Association (ACA), the Psychotherapy and Counselling Federation of Australia (PACFA), or the Health Complaints Commissioner Victoria.

11. Intellectual property

All content on our website, including text, images, resources, worksheets, and course materials, is the intellectual property of MindMotion unless otherwise stated. You may not reproduce, distribute, or use our content for commercial purposes without our written permission. Resources provided for personal use (such as worksheets and psychoeducation guides) may be used for your own non-commercial purposes only.

12. Limitation of liability

To the extent permitted by Australian law, MindMotion's liability for any loss or damage arising from your use of our services or website is limited to the fees paid for the specific service giving rise to the claim. We do not accept liability for indirect, consequential, or incidental loss. Nothing in these terms limits any rights you may have under the Australian Consumer Law.

13. Governing law

These Terms of Service are governed by the laws of Victoria, Australia. Any disputes arising from these terms or your use of our services will be subject to the exclusive jurisdiction of the courts of Victoria.

14. Changes to these terms

We may update these Terms of Service from time to time. The current version will always be available on our website. Continued use of our services after any changes constitutes your acceptance of the updated terms.
